Article 1: General provisions
The webshop of Marlière , a private limited liability company with registered office in Keerbergen, Mechelsebaan 33/2, Belgium, VAT BE 0636 990 288, offers its clientele the opportunity to purchase clothing online.
The present General Terms and Conditions are applicable to all the goods in the Marlière range and to any orders the customer places with Marlière.
The customer accepts that these Terms and Conditions only apply and this to the exclusion of the customer’s own general or specific terms of business, even if they were to stipulate that solely the customer’s terms of business prevail.
Article 2: Price
All our prices are quoted in euro, inclusive of VAT whether for Belgium or any other European country. No VAT is charged on orders with a delivery address outside of Europe.
Please contact our customer service department (see article 12) for further information on delivery charges for international orders. Shipping, reservation and administrative costs, if any, are always listed separately. The prices listed only apply to the goods as described in writing. Marlière reserves the right to change the sales prices and any other charges at any moment in time. Goods purchased are invariably invoiced at the prices listed in the confirmation e-mail.
By placing an order, the customer accepts that the invoice is issued in electronic format.
Article 3: Offer
The goods are intended for normal private use only.
In spite of the fact that the website was produced with the greatest attention to detail, it can never be excluded that the information provided is incomplete, contains material errors or is no longer up to date. Marlière shall not be held accountable for any errors in the descriptions of the goods, the photographs published, sizes or colours.
In the event of specific questions in relation to e.g. sizing, colours, availability, delivery lead times or delivery methods, kindly contact our customer service department (see article 12) beforehand. Offers are strictly valid while stocks last and can be amended or withdrawn at any time. Marlière is entitled to – without stating reasons – decline orders, change the delivery lead times, split deliveries, or to subject deliveries to other conditions.
Article 4: Complaints
Any visible damage to and/or quality issue with an item or any other problem at the time of delivery must be reported immediately, on pain of extinction of rights.
For admissibility purposes, the complaint must be made in writing and forwarded by e-mail to firstname.lastname@example.org whereupon the item must be returned at the customer’s own expense. Any defect must be reported within 1 month of discovery. Once that deadline has expired, any right to replacement expires.
The warranty does not cover defects caused by accidents, negligence, falls, abnormal or incorrect use, use of the item inconsistent with its intended purpose, non-compliance with the user instructions or manual, alterations or modifications to the item, harsh handling or poor maintenance.
In the event of dispute, solely the courts of the judicial district of Leuven have jurisdiction.
Article 5: Cooling-off period
Consumers are entitled to notify Marlière that they wish to cancel their purchase without being liable for penalties or provide a reason within 14 days of the day following the day of delivery. Customers who wish to exercise their right of withdrawal must contact the Marlière customer service department within 14 days of delivery and return the goods at their own expense within 14 days of delivery to Marlière, Mechelsebaan 33/2, 3140 Keerbergen. Goods with a sales price of 100 euro or more must be returned by courier.
Returns must be notified in advance to email@example.com. Unannounced returns will not be accepted. Only goods in their original, undamaged packaging, with all their accessories, user instructions and invoice or proof of purchase will be taken back.
Shall not be accepted on any account:
- used, soiled, damaged or incomplete goods.
- goods whose packaging (or part thereof) was opened.
Should you wish to avail of your right of withdrawal, Marlière undertakes to refund any payments you may have made by return and in any case within 14 days of having been notified of your decision. Your payment will be refunded via the same payment method as the one used to perform the transaction and free of any and all charges.
Article 6: Validity of the agreement – non-renunciation
The invalidity, unlawfulness or nullity of any one provision of the present Terms and Conditions shall not in any way affect the validity, legality or applicability of the other provisions. The failure on the part of Marlière to, at any time, enforce any of the rights listed in these Terms and Conditions or to enforce any of its rights, shall never be construed as a renunciation of the provision in question or affect the validity of those rights.

Article 8: Amendments to the Terms and Conditions
The present Terms and Conditions are supplemented by other terms and conditions explicitly referred to herein and by the Marlière general terms and conditions of sale. In the event of an inconsistency, the present Terms and Conditions shall prevail.
Marlière shall at all times be at liberty to change these Terms and Conditions without further notice. By placing an order following any such amendment, the customer expresses his consent to the new Terms and Conditions.
Article 9: Evidence
The customer accepts that electronic communications and backups can be used as evidence.
Article 10: Applicable law – Competent court
The present agreement is governed by Belgian law. In the event of dispute, solely the courts of the judicial district of Leuven have jurisdiction.
